MONEY BRIGHT LOANS PTY LTD TRADING AS THE MONEY COLLECTIVE

1.    The Money Collective (“we”, “us”, “our”) either online or in-person, these are the Terms and Conditions for the Service (Online Course, as described in the Schedule). Please read them carefully before acquiring the Service (Online Course).

GENERAL ADVICE DISCLAIMER

2.    We do not provide personal, tailored advice online on social media platforms, in marketing emails, in direct messages on social media platforms, on our website, in our website hosted blog articles, in our podcasts, or anywhere that is in the public domain.

3.    Information we disclose in the public domain on our website, in the Service (Online Course), digital profiles, social media channels, and podcast is general in nature. It is for educational and empowerment purposes only, and does not substitute for professional personal financial advice. It does not take into account any financial needs, circumstances, objectives, or concerns, and is not suitable to be acted on of its own accord. We recommend people consider the information we provide considering their own circumstances and seek their own personal financial advice on their situation before taking action.

6.    These terms and conditions of service govern the access and use of our website themoneycollective.com.au ( “Site”, “website”) and any other digital assets managed by us. By accessing, browsing, or creating an account on our Site to access the Service (Online Course) you agree to comply by these terms and conditions.

a)    Unless otherwise stated, the material published on the Site is subject to Australian intellectual property laws and you agree to abide by all copyright notices and other restrictions contained in the Site and in the unit materials. You agree that the Site itself, including all Content including visuals, videos, audio files, documents, html/css, images, words, products, services, and/or combinations thereof made available on our Site are owned and maintained for your personal use and information only. You are permitted to access this information and download documentation template resources for your personal use only. No content may be copied, (including framing pages from the Site) reproduced, republished, uploaded, posted, transmitted, distributed, or used for public or commercial purposes. Modification of our Site content or use of the content for any other purpose is a violation of these terms and conditions and our other proprietary rights, and may be subject to monetary damages and penalties. You may not distribute, modify, transmit or use content of the Site or any of our digital content, including any and all software, tools, graphics and/or sound files, etc for public or commercial purposes without our express written permission.

b)   All trade names, trademarks, and images or bio information of people or their stories on our website and across our digital assets are our property of or used with permission by us and are not to be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or used for public or any other commercial purposes unless with express written permission.

c)    Purchasing the Service (Online Course) with us, you are guided to create an account and set a username and password (this is your ‘login information’). You must maintain confidentiality of your login information, and you must not allow or authorise any other person to use your login information. You must immediately notify us of any suspected or actual unauthorised use of your login information. You should update your password on the website should you believe any unauthorised access will take place, is taking place, or has taken place.

d)   Where you have purchased the Service (Online Course), you agree not to attempt to circumvent any access restriction mechanisms on our website, use the Site in any manner that would damage or disrupt the Site or any use or access to the Site, or interfere with any functionality or viability of the website.

e)    You agree not to damage or delete or alter any part of the website or content therein.

f)     You agree not to use our website to transmit or embed any virus or potentially harmful code.

g)    We reserve the right to remove, re-organise, refresh, update, and add to our website functionality and/or content at any time.

h)   We reserve the right to restrict, limit, remove, or terminate your account at any time.

i)      We reserve the right to monitor your use of the website and generate reporting thereof.

j)      While we take reasonable effort to include accurate and up-to-date information at the time of publication on our website, but due to the rapid change in the economic climate we make no warranty or claim to its accuracy over time. We take no liability or responsibility for errors or omissions in the content on our website. Where information is cited from a third party, we provide URL links where possible or references to that third party and the name of the publication being cited.

k)    We are an independent company and references to other companies or institutions does not imply any partnership, joint venture, or other legal connection unless expressly stated.

l)      When you engage with our services or enquire about them, you consent to receive emails and/or SMS messages.

m) We use your contact information to contact you within the professional relationship and send you information you may find relevant. You can opt out of these communications by clicking on the link in the communication and following the prompts or contacting us directly (see “Contacting Us” below).

n)   If you send us comments or feedback about our services, products, experiences, and content, these become and remain our property and we may use these in publications for any purpose without acknowledgement or compensation to you.

o)   We take all reasonable steps to ensure any customer online accounts are secure within the Squarespace platform, including restricting access to our team, but no system whether password protected or otherwise is entirely impenetrable. By creating an online account via our website you acknowledge and accept the risk of your login account data being unlawfully stolen in the event of malicious online activity.

p)   We will not intentionally disclose any personally identifying information about you to third parties except where it complies with our Privacy Policy, available on our website. If you do not agree with our Privacy Policy wholly, please do not engage us.

q)   We will not be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to or use of our website. All content on our website is provided ‘as is’ without warranty or guarantee of any kind, either express or implied.

r)     We will not be responsible or liable for any malfunction or disruption to the website performance, access, or service problems caused by our website hosted by Squarespace such as if the service goes down due to a denial of service attack, the software fails, the connection with Stripe as a payment processor is interrupted, or the platform is down while it is being updated or backed-up.

s)    We reserve the right to monitor, edit, refuse to post or to remove any information and/or materials (in whole or in part) in our sole discretion from our digital assets and social media.

LIABILITY AND INDEMNITY

7.       To the extent permitted by law, we exclude all representations and warranties, express or implied, other than those contained in these Terms and Conditions. Where we are found to be liable, our liability is limited (to the extent permitted by law) at the option of us to the following:

In the case of services supplied or offered by us:

a)      to the supply of the services again; or

b)      to the payment of the cost of having services supplied again.

8.       Our directors, and employees accept no liability for any loss (including loss of revenue or anticipated profits, loss of goodwill, loss of business, loss of data, computer failure or malfunction), or injury or any direct, indirect, consequential, special, punitive, or other damages caused by or as a result of:

a)      your use of or inability to use our Site,

b)      any virus or other harmful, or potentially harmful, code which may be transmitted in connection with use of the Site;

c)       any information available on or through the Site or on or through any website to which there is a link from the Site; or

d)      Our negligence or the negligence of any of our related bodies corporate, directors, employees, provider institutions or agents.

9.       You indemnify Us, our Directors and employees from and against all:

a)      liability for or in respect of any physical injury (including death), or mental injury or relationship breakdown to persons;

b)      damage to property; and

c)       other liability, damage or loss;

REFUND POLICY

10.       We do not provide refunds. Please carefully consider your purchasing decision and keep record of your own account login username and password. Once you have paid for access to the Service (Online Course) it is non-refundable.

DISCOUNTS POLICY

11.       From time to time we allow for discounts using Discount Codes on our website. The quantity of codes, the timeframe they are available for, and the amount they discount off the total product price is at our discretion and we reserve the right to offer them and change them as and when we deem appropriate.

CHANGES TO THESE TERMS AND CONDITIONS

13.       We may amend our Terms and Conditions of Service from time to time. The current version will be posted on our website and available upon request.

THE SERVICE (ONLINE COURSE) SCHEDULE

14. Online Course – The Money Collective Financial Wellbeing Program

Customers who purchase the online course are purchasing access to the online course content only. The access being purchased is for 12 months from the date of purchase. After 12 months has passed, access will be revoked.

If customers wish to access the course content again after 12 months, they can purchase access to the online course again.

The online course content is not personal financial advice and is not guaranteeing an outcome. It does not provide advice on investment strategies, investment products, risk management, or growing wealth.

The online course content provides the tools, framework, and video guidance to better understand a persons current financial situation and write their vision, goals, and priorities to progress towards their own unique financial future.

The online course content is made up of 12 key steps which each include a worksheet and a video. Plus a Spending Plan spreadsheet, and a Financial Wellbeing Plan template.

ACKNOWLEDGEMENT AND ACCEPTANCE

15.       By paying the fee to access the Service (Online Course) as detailed in the Schedule, you acknowledge and accept these Terms and Conditions.

 

The Money Collective is a trading name of Money Bright Loans Pty Ltd as trustee for the Money Bright Loans Trust (ABN 80 911 949 501). Money Bright Loans is owned by Peace Makes Happiness Pty Ltd (ACN 633 966 800) as trustee for the Peace Makes Happiness Family Trust and Logan and Lily Pty Ltd (ACN 169 046 842) as trustee for the DA and DA Neu Family Trust.
